Hi all,
This is urgent, your response is appreciated. I am switching jobs and my new employer wants me to go to the UK for some training in a week for about 5 days. They are sending the H1-B transfer application in couple of days, so the transfer has not been done. The img. lawer said they will send the receipt notice to me in the UK and I could travel back with my previous H1-B visa from my previous employer. I am a citizen of India woking in the STEM field for the last 2 years. I am still working and my employment will last for about 1 more week.
QUESTIONS:
1. Please let me know you see any problems at immigration when coming back to the US?
2. Can the employer wait couple of more weeks before sending cancellation of my H1-B visa without paying me during that time?
3. If I take an unpaid leave durimg this time, will that help?

I am on my 7th year of H-1B (not stamped) and H-1B is due to expire in 2011. I am with the same employer since beginning of H-1B. My AOS is pending and have received AP and EAD.
I am planning to visit Canada next month and want to enter USA with the help of AP. My question is Can I continue my salary using H-1B with the same employer? I read somewhere that I can use my H-1B for salary processing in such circumstances provided I am working for same employer.

Just Ask her to redo the I-9 Employment Verification form and submit to the Employer. Nothing else needed.

Hello,
There are lots of articles/news around this issue, but so far these have been exceptions than rule ... I myself entered US through a completely different airport than where I'm employed (on H-1B) and didn't have any issue.

I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.

I think they can fire you at anytime, even when you are in the US. I wouldn't withhold my vacation plans for the fear of getting fired while you are on vacation. If you get fired while you are there, you can apply for a visitor visa to come and pack your stuff. It is a very valid reason for you to come back.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?
It depends on several factors...
Example PERM Job requirements, reason for 140 denial...etc

Trying to get my green card (11 Years in the waiting) .
My I-140 was denied / and we have applied for Motion to Reopen . in the meantime, i have my AP approved this 2011. can i switch employer.

I have applied for my I140 under EB2, I have a question regarding a gab between my employments. I worked for a company A from Dec 2005 to Feb 2007 and then I switched employers, and I was between projects. The next company I started working for gave me an offer letter only when I found a project (May 2007). So technically there is a 2 month gap. Even the experience letters from that company says I have started work from May 2007.
I'm not sure if this will cause a problem in my I140 stage. Kindly advice.
I have changed two companies after that and I'm filing my GC through the current company. Any response will be much appreciated.

They may even shed a tear at our sorry plight.
