Hi,
My current employer filed my labor and 140 in 2007 under EB3 and are also approved. Now I am planning to move to a different who is willing to start my GC under EB2. Now can i use 2007 as my priority date?

As long as you are in status it is fine, what you need is a valid I-94 or a receipt showing that you applied for a timely extension. You only submit documents that are asked by the officer.

I'm in Spain this week so can't give the full treatment, but thanks to readers who sent this happy news. The US has won the Nobel Prize in medicine for work done by these two scientists as well as Carol Greider. Blackburn is Australian-born and Szostak is British-born. They received their award for genetic research that is described here.

Hello -
I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

Hi All,
My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".
Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?
Please advise.

If you apply in April 2011 for 2012 quota, yes you will need to go out on/before June 2011 and come back in october 2011(will need H1B stamping too).
On the other hand, If the H1B quota for 2011, which can be applied from April 2010 is not exhausted until you apply in 2011, You can stay and apply with out any problems, but this seems very remote, if not impossible.

Company "A" negotiating with a person who does not have paystubs, as he always been on bench.
during this time Company "B" apply for H-1B Transfer(without paystubs as they plan to submit later in a week or so)
Company "A" did the settlement and issues paystubs etc... but same time they apply cancellation of H1.
My I-94 is valid untill dec-09
Can a transfer be done like this???
Please advise as i am dying day and night.............do not make a fun of it.

I have this thought. We start a letter campaign sending letters to all the house members: 1) To get them aware of Legal immigration and 2) To put our case fwd.
I feel it will be very effective as the flower campaign. Atleast most of us can participate in it, less expensive, less time consuming. And we can see why we wouldn't they respond to the bulk of mail they are getting every day.
I know we did letters through email etc. But i think sending through post will be different and they will be obligated to respond.
I do not know whether this is a good idea. so please dont rush at me.:)

I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.
I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.
Please advice. What should I do.

Hi All,
We had filed for AP from NSC for my wife in Oct. She needs to travel on 1st Feb, so we took a local infopass appointment hoping to have local office issue AP. Two days before our local Infopass appointment, online status for my wife's AP said that they have requested further evidence. We are yet to receive the document for same so do not know what evidence they are asking for.
On Friday, when my wife went to local Infopass office, she was told that they can not issue local AP if her case has an RFE at NSC center, and was told to wait for the document. We are in a bind right now as she needs to travel and local office wont issue AP.
Any suggestions for this one? Have already contacted NSC twice to get details on RFE but they are also saying wait for the letter :-(

Here's my take on the new Visa Bulletin First, bad news for Dominicans. Separate cutoffs have now been established for the Family First and 2B preference categories which are now earlier than the worldwide dates. Family First is 01 JUN 2004 and 2B is 01 JAN 2002. Also, Indian numbers are pretty bad again with most categories stalled. Mexico is the only bright spot with some strong improvements in the employment categories. we are on last stage approved i-130 USA citizen for married daughter.
because we overstayed in USA since 1996 here do we have to leave country since we applied only in 2003?
this would be a disaster since we have nobody in Italy that con support us until get a waiver from USA counsolate....they said about 9 months if everything is ok...
my only hope is that a read something about cancellation of deportation and adjustment of status here in USA no needed to leave country...how dangerous can be to start this process, wile waiting for last stage of i-130?
i have good business, house, cars, furniture here and always paid taxes. 2 USA kids. thanks gimme hope

Hi all. I'm looking for a little help with part 2 of I-485. I've sent off my I-140 and I am hoping to apply adjustment of status concurrently. I wondering which box to fill in part 2. A. looks the closest, it reads: 'an immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice......)' My trouble is this: If my I-140 is approved then my visa number is no problem, it is current for my category/country (outstanding professor/Canada). Since the I-140 is pending, this looks like the wrong box, however, none of the others look even remotely close. Any help would be greatly appreciated. Bark
