I listened intently to President Obama's State of the Union speech yesterday. The man is clearly a gifted orator. He stressed the need for cooperation between Democrats and Republicans on the big issues facing our country: the economy, climate change and health care reform, but where oh where was immigration? Finally, after the President was over one hour into his speech, I heard the word "immigration". One sentence. It came and went so fast that if you turned to your spouse and said, "Okay, here comes the President's plan for immigration reform", you would have missed the whole thing. Here...

"In heated, election-year politics, the facts often take a backseat to campaign rhetoric - particularly when it comes to immigration. In an effort to defend the facts and provide basic answers to the most commonly asked questions, the Immigration Policy Center releases Giving the Facts a Fighting Chance: Answers to the Toughest Immigration Questions (http://www.immigrationpolicy.org/sites/default/files/docs/Giving_Facts_a_Fighting_Chance_100710.pdf). (PDF version)"

If you want to retain your priority date your I 140 should be approved from your old employer, else you need to start from scratch again.

Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

Hi Attorney,
Can you please let me know the answers to the following general questions.
For an individual, let’s say an I-485 was pending since July 2007 (I-140 approved) with current employer A and she moves to an employer B on a similar job on a H1-B transfer invoking the AC21 portability.
1) After the move, if the I-485 gets denied, can the person still retain the priority date of the underlying approved I-140 in any new application if she files with the same or a new employer.
2) After the move, if the I-485 gets denied and the person loses her job with the employer B, can she take a job with employer C by transferring the remaining time on her H1-B visa.
Thanks in advance.

Hello everyone,
My questions are about F1 to H1b change status.
I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?
3. In my situation, what should I do right now? Do I need to find a school to keep my F1 visa? When is the best time to find a school?
4. Can I transfer H1b to another company during my H1b is pending?
I am very appreciate if you can answer these questions. :)

Hi
I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.

The category (EB2/EB3) doesn't get transferred. Only the PD can be transferred. So, you will get the old PD for EB3.

USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. I presume this means that just a few hundred cases are being processed per week which is simply remarkable when you consider that there has been a lottery for H-1B numbers for the past two years. In my view, this is solid evidence that H-1B workers are not cheaper than their American counterparts. When one factors in the government fees, lawyer costs, travel expenses, etc. and the fact that employers are required to pay the prevailing wage for a...

Hi,
I know that this is not a "Green card related" question but an important question that I hope someone will answer. I am planning to use EAD after my I140 approval and jump to consulting business. I have thought about Self-employment but it sounds like it is risky. Are there any good consulting companies which charge very less percentage for having me as an employee on EAD. I hope that company can send AC21 and continue my GC processing.
Thanks,

I need an advice.
I was in US since Apr 1999. FIled for GC in oct 2000. I got my I-140 approved. But then i had to go back to india as my company transferred me to india office in Oct 2001.
I left that company in jan 2004 and joined another company in india. Then in July 2004 i came back to US thru a consulting firm. An din jan 2005 my client offered a job. So since Jan 2005 i am working at the cients office as their employee. I filed for LC in Sep 2005, it got approved in oct 2005 (Just mised by 3 weeks)
My question is was was it possible to use the PD from my previous GC. which is Oct 2000.My atternoy told me it is not possible. But i saw similer posting on IV, hence i am curious. Also if possible is there any way i can get the old GC at this stage,my I-140 is approved this time too.,

5 more Representatives co-sponsor for CIR ASAP of 2009 bringing it to 102 sponsors.
However, unless the Senate moves on Immigration .. nothing will happen in the House.
What happened to STEM bill? When is it coming to senate?

No. It goes to the attorney.
I had an RFE on a I765 last week, and it went to the attorney. I expect to get the card directly however. Strangely, the approved travel documents go to the attorney as well.
