Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

I'm going to guess that the same folks in the Tea Party screaming about the deficit will somehow find this breaking news to be irrelevant. They don't verify anything. They ask you to fill in a form I don't remember the form number. I remember they were asking your full name, SSN, Address in US, Country of citizenship, place of birth, your father's and mother's first name.

I am on my OPT (started on 5th Jan 2009) currently and am working for a startup company. However, I am told that the company has funds only to support my position for another 2 months or so.
But the company is ready to sponsor my H1B for April 1st this year to help me keep my immigration status. My question is if my H1B application is approved this year but I loose the job before the H1B kicks in (1st October 2009) can the approved H1B be transferred to a new company, if I get another job?

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

I am stuck out side of US for my name check for last 9 months. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.
Some one has told me that I can use consular processing but have no idea about that.
Please help me and let me know what are possible options for me to return to US.

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?

My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

Saw in a IV post (looking for the link) that an NSC IO told that they will adjudicate applications with Name Check pending only if they dont hear back from FBI by November,08. Below link may offer some clues on why "November".

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.
