We should not let Cornyn down due to this bill's failure. We have to send email and thank him for bringing up this bill eventhough it failed. This will keep up his spirit and make him feel that there are people behind him even if this bill failed. This will make him to pursue other amendments in favor of legal immigrants if at all there is a slight chance before this NOV.
So let us thank him. Should we? Yes if IV says.

I went thru' both links posted above in thread.
It seems that according to RG, EAD will remain valid till the time to file appeal (MTR), once appeal is filed the applicant would be able to work. He also suggested to go on EAD to save any time remaining from initial 6 years.
According to RK, EAD will be invalidated, person is to be deported as soon as CIS denies 485 in error. He strongly suggest NOT TO GO on EAD if some one has H1 as an option.
According to Chandu's blog, RK seems to be correct; but then RG is also a very reputed and experienced immigration lawyer.
What is correct? Both are 180 degree opposite to each other? Any one?

People are burying these posts as spam.. can we do something to make sure that doesnt happen?
I guess that tells how much public cares about our GC's. We want to spice up the story by adding other issues that can make our situation worse.
The only way we can get 4000 diggs is by having every info lurker digg it and individual comments.

I think I am missing something.. Can anybody explain what they did today.. I am still trying to find out difference .
Thanks.
What the USCIS has done today is what they call "Locking the stables AFTER the horse has bolted" ;)
What a bunch of idiots, i swear this is WORSE than ANY of our home countries. Like I told my friend yesterday, atleast if the USCIS call center was based in India, the answers would have been consistent. They may have all been Wrong, but atleast they would be consistent.
Thanks.

Given the current market conditions,I dont think there will be a lot of new EB1,EB-2 ROW filings.Given that EB1 and EB2 ROW are current, there will be considerable overflow to EB2 I and C.The chances are very good that EB2 I and C will move faster than it moved late last year and early this year.April 2009 quarter opens new Visa Numbers too,If EB2 ROW and EB1 are slowed because of economy then certainly there should be some additional visa numbers available for EB2 I and C.At this stage it depends on PERM EB2 ROW data.

In order to avoid visa wastage, there is no ‘per country limit’ during the last quarter, that could be the main reason for this quantum leap in EB2-I PD movement.
Looks like DOS was not clear about the number of pending cases until a month ago and that’s why this movement was not happened last month - July, which was the first month in last quarter.
There could be two reasons for this huge forward movement for EB2.
1) They want to minimize wastage by making more visas available for CP.
2) There was some heartburn among EB2 China applicants when their PD was set to April 2004. Since there are a lot more EB2 India applicants with PD's earlier than that, they felt that most of the EB2-ROW spillover would go to India. Moving the dates forward to 2006 would ensure that EB2 China gets a decent share of the spillover.
Although this is unfair to folks with earlier PD's and is sure to cause a lot of heartburn, I would rather see the visas get used than get wasted again. Looks like the USCIS is setting a pattern of giving a year end bonanza to a few fortunate folks. Let the annual sweepstakes begin! Good luck everyone!!

Hopefully the emphasis on homeland security will not have an adverse effect when dates become current again or move forward.
On a lighter vein, isn't this essentially what we need - quick processing and approval of 485 apps without being stuck with all the paperwork? :)
Changing title to "Homeland security compromised in mad rush to process Green Cards" may provide fuel to anti-immigrants. They may argue that the process is better served by taking for 25 years to ensure no would be terroists get green cards !

Apparently, we were pretty pretty close to getting retrogression eradicated in the lame duck session, according to an IV core member.
Now based on that, can you lose heart?
I think we should continue calling Sen.Cornyn's office and keep him motivated to get the SKIL bill tabled and cleared in the next congress. ;)

Wow, there you go! How come it becomes not 'stupid' when a girl spends husband's money to support her parents?
This, effectively, means that if the girl stops earning for any reason such as pregnancy or is unable to earn, she immediately forfeits the right to send money to her parents. This is the most illogical statement I have ever heard.
And it also means that for any reason, if a girl remains a house wife, she has no right to send any money to the parents like you, as the earning member, do.
This is the very strange attitude that may get a marriage in trouble.
Why shouldn't a husband send money to his parents from his earnings? The husband and wife can talk about it and based on circumstances take a decision.
BUT if the girl takes for granted her rights to spend for her parents from husband's earnings, then it becomes an issue!
Did I even say husband shouldn't send money to his parents from his earnings?
But shouldn't that be also need-based? How come it is the right of the husband to send any amount of money he wants to his parents without the wife complaining and how come it becomes a case of "taking for granted" when a non-earning wife wants to send money to her folks in need? This is a hypothetical situation and nothing to do with OP's case.
And then how is it we, husbands, are the first ones to start complaining when our wives don't get a share of our in-laws property following their demise?
And tell me then, following a divorce why are there laws which require you to split your net worth evenly with your non-working ex-wife? Is that acceptable to you then or you want to put forth an argument that "hey, we don't have a child and she is no longer my wife and so I am not obligated to give her a dime"

To the commenter who red dotted with the comment
"bas*$%^&d - Take it easy. Either u want the system the way it is, or if u want it reformed, someone else has the equal right to get the benefit. I want the people with oldest PD's to get GC first; but please be nice to others.
"
I dont think I said anywhere in my post that I don't want "someone else to have the equal right to get benefit"...
What I actually said was in fact that everyone (not just some lucky ones) should have the equal right to get fair benefit within the scope of the existing set of rules that USCIS has itself put in place (Honoring PDs etc).
Please read posts carefully before commenting. And I personally usually refrain from giving red dots and comments in the backgroudd (Somehow it just seems a bit cowardly to me..but that's just my personal opinion).
And as far as bas*$%^&d, it was just a way of expression...Haven't you heard the phrase "You lucky bastard"
...although I agree people could percieve some element of frustration in there...and hence the 'no offence' additive in the brackets in my original post.
I would rather be frustrated at USCIS which richly deserves everone's anger/frustration, than at some unknown lucky bas*$%^&d :D
Now please go ahead and give me some greens so I can become eligible for the IV chat feature.... :D
Btw, I also came across a 'red dot vigilante', who gave me a red dot with the comment "I usually give red dots to people who complain about red dots" . (This was for some other post). Nice work sir...You seem to have a lot of time on your hands to do some vigilante work on the side lines :) . Please give some red dots to USCIS :D

All,
When this July bulletin was released, I had given the following points in that thread.
I am seriously considering this. Indian economy is going to go leaps and bounds and I dont want to miss out on that. And wait here in the whims and fancies and their ridiculous illogical visa bulletins by these people. They shouldnt harass and take Indians for a ride. We are paying our taxes and all the fees and what not. Still they prefer illegals over us.
Enough is enough. I have self respect.
Looking at this visa movement for the past year and the current economy, I am just giving up hope to get GC in this country folks.
I am seriously thinking about going back to India. The reasons I was proding over are:
1. Well.. first and foremost, no hope of visa movement in near future.
2. Employer uncertainty. The company is not doing too well.
3. Tough job market and US economy will drag like this for another 2-3 years.
4. If they lay me off, I will have to find another job first. I havent even applied for 485 yet, so no EAD and priority date is Feb 2008
5. Restart GC again which is another excruciating process - moneywise, timewise.
6. Wait again in the line for visa movement
7. No career advancement because cannot jump companies and I am already early 30's. (I am non-IT). Career is stagnant, company doing very small projects.
8. Cannot even think of having kids because job and life here is hanging by a thread.
9. Cannot buy a house in this market. Its not that I dont have money, was thinking, if I lose the job, I wont get much time to sell it off and I will have to incur losses.
10. India is doing well and going to to do well in the future.
Is anyone else thinking on these lines?

I have a loan with LIC. The rates are pretty good and no-prepayment penalty if paid using NRI funds only. Took some time to set all this up. Definitely need a local person to carry out all the paperwork and good support from the builder. Their email system is not very efficient. Tried with HDFC before this in Hyd and had lots of problems getting the loan even after contacting the CEO.

* According to the State Department, from October 1, 2006 through May 30, 2007, the USCIS requested and was authorized the total EB visa numbers of 66,426. Between June 1 and the first few days of July (?), the USCIS requested and was authorized over 60,000 EB visa numbers, in approximately one month. Since it has been made clear by the USCIS that during the last weekend of June (2 days) the USCIS approved 25,000 EB 485 applications, apparently over 40,000 visa numbers were requested and authorized before the weekend. Obviously the 60,000 plus cases must thus have been approved (?) in one month. Hmm............................................... .........................
