Folks,
I have a question regarding travel while on AOS. We are on H1 and H4 (primary and dependent) but do not have the H1 and H4 visa stamps. Planning to use AP.
When we leave the country, do we need to drop the H1/H4 I-94 stubs from the current visa approval forms OR the I-94 stubs issued during last entry? Ofcourse the I-94 nums on current visa approval forms and on visas last entered are the same, but different visa statuses when last entered US.

This is a standard response message which comes after USCIS receives the response to RFE and resumes case processing.
There is no way to determine when the case would be adjudicated and what will be the result. It could happen next week or take months.

Judge Susan Bolton, who heard arguments this week on the first of the Arizona lawsuits, has narrowed the issues she is considering blocking before the law takes effect next week. Some sections that are not in dispute, such as the provisions on day laborers, will take effect on the scheduled date. I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

Well need some help. I moved from H1-B to F1 visa to do masters. Now I want to quit F1 in middle and go back to doing H1-B and continue masters part time.
I know there are still slots open for H1-B for 2010. Please correct me if I am wrong.
Now I can do summer internship untill August 26, the question is, how can I work for the employer for the month of September? since H1B starts on Oct 1st. I can do CPT full time but, then again I heard you can not quit CPT in middle of the semester.
Any suggestions will be greatly appreciated.

If it was filed in the EB2 category, it is likely that they picked the case for a random audit. EB2 labors do get audited during PERM processing to ensure that the case does meet eligibility requirements for EB2. There is no clear pattern to this auditing though, some cases get audited and some do not.

Can we go to USCIS office after 90 days of filing I-485 to get EAD? Also, does the 90 day counter starts once we file or when we get the receipt from USCIS. Please advice!

The Senate Homeland Security and Governmental Affairs Committee voted today to scrap the controversial REAL ID law which will require states to begin implementing tough new standardized technology requirements for drivers licenses in just a few months. In case dependent is in India and priority date is current. Will this impact on getting EAD for dependent and primary applicant.

yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

The D40 requires an AF-S lens as far as I know, I have never actually used one. I know it will work wit the D70. I recommend trying it out before buying it if that is possible. It works on the D70 by setting everything to manual. Good luck
