people,
i just returned from an infopass meeting... the guy i talked to said that they recently have a directive from the DHS/USCIS that they want to separate the legal stuff from the illegal stuff and hence they are planning to adjudicate a record number of EB apps in the next quarter or two... does anyone else concur? is this true or were my ears just ringing in that meeting?

Did you get your I-140 receipt? What is the online status?
My company would not provide me with I-140 receipt or approval notice. They would just inform me of the status.

I think we are getting into an unnecessary discussion. My objective of this thread was to point out to our members that when we are discussing about immigration issues in the media we should also expose the mismanagement of the USCIS. They should not get away just by saying we were not prepared for this....

I am july 2nd filer!!!!!
I spoke to NSC today and they told me that he told me that you need to wait 45 days. OR your check is cashed, there is no way they can check tes system and find out the status for you.
I am glad it will be done this week end!!!!

I have talked to a representative and he very patiently explained me about the mess.
He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.
He mentioned that they are working hard to meet this deadline.
Hope this clears the anxiety.

I have recently tried to explain them the EAD/485-pending concept and failed.
At the end, they waived their commission of 1%, so that I don't have to pay that amount.
The bank is GMAC.

Given that IV was majorly instrumental in reversing the July fiasco, the least I could do was contribute money.
I am also planning to contribute time by volunteering for Texas state chapter activities.
The turn of events in past month clearly highlights what concentrated lobbying can achieve. We need to keep up the pressure.

I believe everyone is thinking in the same direction... but if and only if we're able to come out of the blackhole called I-140.
Well, you don't need to wait for I-140 to come out of the blackhole if you are dumping the old case and starting a new EB2 case. According to my lawyer, new EB2 140s are getting processed at a much higher rate than those EB3 140s that were filed July 07.

i think I have stated it earlier...
for handsfree , you could either do it through accountant or legalzoom.com once you set up the company, you need to get your Federal tax id for the company, then file for any local city business license ( few cities have that requirement), Open a bank account...

Since we are trying to address I-140 delays in general at TSC and NSC, can we just send a general letter to Ombudsman's office without specifying our case and DHS Form 7001 ?
This way it will turn out to be a letter campaign.
What do you think ?
My understanding is if you send a general letter, you will get a general response (standard template) from the Ombudsman's office. For that matter, you don't even have to send the general letter, because I will provide you with the response you can expect to receive from Ombudsman's office without the DHS Form 7001.

All I am trying to emphasize is the DHS Form 7001 is absolutely necessary if you want them to investigate the problem and see for themselves if what we are complaining about is indeed true. You stand a chance that they may take steps to address this problem. If not, it is just waste of time and effort. There is nothing to fear by providing the case details to Ombudsman's office. There are people who have sued USCIS due to the delays and have won their cases....so why fear when all you are doing is requesting USCIS to process our cases in orderly manner.
So please take the time to mail the letter & the completed DHS Form 7001 to the ombudsman's office.
This way it will turn out to be a letter campaign.

I dont have any opinions on the main topic here - just wanted to chime in on this one...
Many CEOs work for $1 a year - thats just the salary component and only one side of the story. There is another side to it - stocks and options. No one gives up the stocks that they keep getting every year..infact, for many of these guys, the salary is just a drop in the bucket. Their real cash cow is the hundreds of thousands in stocks that they receive each year. Nobody gives those up. The $1 per year is mostly a publicity thing...
So this actually supports my point. There is no "loophole" to close.
I recommend my friends snathan and swissgear to avoid actions based on jealousy over people just like yourself. But hurting them you hurt yourself

My pain is similar to yours buddy mine also took 6 months to file. The VB is now an monthly sadness event, even my wife is waiting for EAD, in the current time its almost impossible to get a job if one needs sponsorship read H1, despite being well qualified and having work experience. Also if we have EAD you probably would not have to go through H1B Extension (RFE's), I had to undergo this as well, fortunately my stamping was smooth. Until our day comes we just have to wait, I think the only chance is the new proposed 485 filing procedure when its implemented.

but the proposed 2 tier system has been pushed from this december to next June 2010 (i.e 6 months) as of now, not sure whether they will come up with it at least in June...

If one thinks with cool head, what you said makes sense. also if you remember when EB3 (I) was actually retrgoressed on Jan1/2005, the PD was jun/2002. Then it was retrogressed all the way back to 1999 or something. Later on, slowly it came up to March/2001 & stopped there for a while due to the so called 'Hump' (due to 245i cases, i think)
AND slowly but steadily PD for EB-I crawled up to Nov/2001 until May2007.
Suddenly in June'07, the PD was advanced to June/2003 and i know so many pending cases were cleared around july and august of 2007.
So far what i've mentioned are all facts only.
Now looking forward for fiscal year allocations starting from Oct'2008, i can say the PD for EB-I will begin atleast Jun'2002. May be even a better PD but i'm not sure. For sure there is a good chance of making progress to end of 2003 when it comes to Sep'2009. This is based on availability of only those visa numbers as mandated by law as of today.
